RED HOT POKER TOUR – TERMS AND CONDITIONS

  1. By playing in Red Hot Poker Tour Tournaments you could qualify for the Tournament of Champions and could win the Season Grand Prize which can include playing in poker tournament events such as the World League Championship event(s), World Series of Poker® or World Poker Tour® poker as part of Team Canada Poker. “World Series of Poker®” is a registered trademark of Caesars Entertainment used under license. “World Poker Tour®” is a registered trademark of WPTEnterprises.
  2. Definitions:
    • “Leaderboard” generally refers to the Championship Qualifiers leaderboard.  Players must be properly registered for Red Club (www.redclubroom.com) prior to THE FINAL DAY OF THE SEASON to appear on the Championship Qualifier (CQ) leaderboard and be eligible for any championship events or prizing. “Championship” generally refers to the Tournament of Champions but can refer to special events.
    • “Grand Prize”, “Prize”, “Prizes”, “Prizing” generally refer to World Series of Poker or World Poker Tour tournament entries but can refer to other prizes.
    • “Prize Winner” generally refers to the winner of the Tournament of Champions, but can refer to other special events.
  3. By registering for Red Hot Poker Tour and/or taking part in any Red Hot Poker Tour Tournament you provide your express consent to receive electronic, verbal and/or written communications about the program and all offers from the program and promotional partners.

  4. TOURNAMENT OF CHAMPIONS:

    • The top 120 players on the Championship Qualifiers leaderboard (most points accumulated during the season), plus any eligible qualifiers as deemed by Red Hot Poker Tour, are invited to the end of Season Tournament of Champions.  The winner of the Tournament of Champions is the Season Champion and can receive the Season Grand Prize.
    • Qualification to a championship or prize event is non-transferable, and cannot be postponed to another Season.  The Tournament of Champions is an invitation only (by email) event for qualifiers.
  5. Prize Eligibility:
    1. You must be a registered Red Hot Poker Tour member and remain in good standing.
    2. You must qualify for the Tournament of Champions by accumulating enough points to qualify as one of the top 120 players on the final Championship Qualifiers Leaderboard at the completion of the season, or receive an invitation as a special event winner/qualifier.
    3. You must be a registered Red Club member with valid information prior to the Championship. Red Club Membership is free and required to qualify for the Tournament of Champions and any prize awarded by the Red Hot Poker Tour. Members only need to properly register for Red Club once, not each season.
    4. Prize winners must be registered Red Club members with a CanadaPokerLive.com account and 1) declare their intent in writing via email to claim the prize, 2) expressly agree to all rules, and these terms and conditions.  The email must be sent to [email protected] and be received WITHIN SEVEN (7) DAYS OF WINNING THE PRIZE. Failure to declare and agree to rules as well as Terms & Conditions by the deadline may result in cancellation of the prize.
    5. If the winner of any prize is deemed ineligible for any reason, Red Hot Poker Tour reserves the right to cancel the prize at any time.
  6. MARKETING CONSIDERATIONS:
    • By accepting the prize as offered by Red Hot Poker Tour, winners are entering into a binding contract agreeing to appropriately wear visible branded clothing and/or patches designated and provided by Red Hot Poker Tour for the duration of the prize Tournament, and all associated Tournaments, as well as during all promotion and/or media events and/or functions.
    • It is expressly prohibited to wear any logo, promotional clothing or promotional/logoed material of any other company unless authorized by Red Hot Poker Tour in writing.  If the winner does not comply with this obligation during or after the tournament where they received a paid entry, they understand and agree that they forfeit 50% of any tournament winnings to Red Hot Poker Tour and sponsors, and may be subject to further legal sanction.
    • Red Hot Poker Tour reserves the right to seek damages for non-compliance with this or any contest rule to the fullest extent permitted by law.
    • By participating in Red Hot Poker Tour Tournaments and/or Championship events, all participants agree to allow Red Hot Poker Tour and its suppliers and sponsors to use and/or publish your name, photograph and relevant personal information for all advertising and publicity purposes throughout the world indefinitely without compensation.
  7. TRAVEL & ACCOMMODATIONS:
    • The winner is solely responsible to ensure they can travel to and participate in the prize event on the dates specified.  Dates can only be specified after the official tournament schedules are released. If the winner cannot travel or participate, for any reason, the sponsor reserves the right to cancel the prize.
    • A passport is required to travel to tournaments outside of Canada and obtaining a passport is the sole responsibility of the prize winner.
    • Prize winners are responsible to coordinate their own transportation and accommodations.  In circumstances where flight and/or accommodation allowance is provided, this can be either be purchased for the prize winner by Red Hot Poker Tour, or paid as one lump sum at Red Hot Poker Tour’s discretion.  It is the player’s sole responsibility to review all terms and conditions attached to their own transportation arrangements.  Winners are responsible for their own airport transfers (ex: taxis), optional travel insurance and all other incidental expenses.
    • If the winner fails to attend, or otherwise is not present one hour before the official start of the prize event for any reason, the player forfeits their right to the prize and it will not be reassigned.
  8. WORLD LEAGUE POKER CHAMPIONSHIP, WORLD SERIES OF POKER & WORLD POKER TOUR REGISTRATION AND PARTICIPATION:
    • Valid government issued photo identification and proof of age will be required to register for any prize tournament.  Prize winners must be the required age as designated by the tournament to participate.
    • International entrants are required to show a valid passport to complete registration. Any winner whose documentation does not adhere to or conform to these requirements may not be able to participate.
    • It is highly recommended that winners coordinate travel to arrive at the Prize tournament location at least 24 hours prior to the event as some events reserve the right to limit the number of players in tournaments and can close registration.
    • Winners are responsible for payment of any applicable taxes on any Prize won.
    • Red Hot Poker Tour shall not be held responsible for any problems, errors, negligence, date changes, or location changes, or an issue that may arise or occur in connection with the prizing and/or Tournament operators decisions/actions.
  9. Winners must accept the Prize as-is. Red Hot Poker Tour reserves the right to replace the Prize at its discretion. Winners may not sell or transfer their Prize to any third party without the express written consent of Red Hot Poker Tour.  No cash or any other type of compensation alternative is available.  If such a transaction takes place, Red Hot Poker Tour reserves the right to seek damages and/or other relief from all persons responsible to the fullest extent permitted by law.
  10. Not eligible to win the Tournament of Champions including any prizing are Red Hot Poker Tour management, contractors, rights-holders, or formally aligned operators/contractors/franchisees of other poker programs, suppliers to Red Hot Poker Tour its divisions, subsidiaries and affiliates, their respective agencies and members of their respective immediate families and/or persons with whom any of the foregoing are domiciled.
  11. Red Hot Poker Tour reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the qualification process, interfere with the rules or terms and conditions, the operation of this promotion or any Tournament, violates these Terms and Conditions, violates the Red Hot Poker Tour Rules, deliberately undermines the administration, security or legitimate operation of the Red Hot Poker Tour or acts in a disruptive manner. Red Hot Poker Tour reserves the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law. Red Hot Poker Tour Management may determine in its sole and absolute discretion if a player is eligible/invited/qualified to play in the Championship or receive any prizing.
  12. The decisions of the Red Hot Poker Tour Management and/or Tournament Director are final, and all tournament entrants agree to abide by all of the instructions and decisions. In the event of any dispute regarding the interpretation of the rules or any decision rendered by the Red Hot Poker Tour Management and/or Tournament Director, the decision or interpretation of the Red Hot Poker Tour Management and/or Tournament Director shall prevail.  Red Hot Poker Tour considers the best interests of the game and fairness for all Members and clients as the top priority in the decision-making process and interpretation of any rules regarding all aspects of the program including the Championship structure, number of participants, date(s), locations and all other aspects of the program. Any dispute or situation not covered by these Terms and Conditions will be resolved by Red Hot Poker Tour management in a manner it deems to be the fair.
  13. Each Member is personally responsible to provide Red Hot Poker Tour with accurate contact/email information.  Red Hot Poker Tour is not responsible for email communications that do not arrive due to filters, technical issues or any other reason.   To update your email information, please email: [email protected] with your 1) full name, 2) member number 3) email address, 4) postal code and 5) last venue played for verification.  Failure to provide Red Hot Poker Tour with accurate contact information before the end of the season may result in the loss of your seat in the Tournament of Champions. Red Hot Poker Tour may use the information that you provide during registration and/or prior to the championship final table, to provide you with updates on the Tour.
  14. Red Hot Poker Tour makes every effort to ensure accuracy and to investigate any member point questions, but assumes no responsibility for points a player may consider as missing from their total.  Members should wait one week before inquiring about missing points and not wait longer than two weeks prior to making a formal inquiry by email.  Member point questions can be directed to the Minister of Points ([email protected]) and must include the following information: 1) Date of Event, 2) Location, 3) Finish Position, and 4) The Tournament Director for the event in question (if possible).
  15. Red Hot Poker Tour assumes no responsibility for any reason for the malfunction of, or damage caused to any telephone network or lines, computer equipment, data or software, online systems, servers or access providers; traffic congestion on the Internet; the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers.”
  16. Red Hot Poker Tour reserves the right, at its sole discretion and without prior notice, to cancel, terminate, modify, or suspend in whole or in part the Championship and/or prizing for any reason and without liability and without prior notice. Red Hot Poker Tour shall not be held responsible for any problems, errors, negligence, date changes, or location changes, or any issue that may arise or occur in connection with the Red Hot Poker Tour or the program in its entirety.
  17. By registering for Membership in the Red Hot Poker Tour and entering any Red Hot Poker Tour Tournament, Members agree to abide by these rules, which are subject to change without notice to members individually, and by playing in a Red Hot Poker Tour tournament, each member releases Red Hot Poker Tour, their respective parents, affiliates, subsidiaries, directors, officers, employees, contractors, sub-contractors, representatives, sponsors, marketing partners, affiliates, franchisees, market rights holders, agents, advertising and promotional agencies, from any damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Red Hot Poker Tour or the use of any prize.
  18. By registering for Red Hot Poker Tour and/or taking part in any Red Hot Poker Tour event you agree to be bound by these Terms and Conditions as well as the Red Hot Poker Tour Tournament Rules and rulings of Tournament Directors.
  19. The Red Hot Poker Tour and program prize rules shall be exclusively governed by and construed in accordance with the laws of the province of Ontario. Any dispute shall be adjudicated in the courts sitting in Toronto, Ontario, Canada.
